f. You are solely responsible any consequences, losses, or damages that we may directly or indirectly incur or suffer due to any unauthorized activities conducted by you, as explained above, and may incur criminal or civil liability.

We may provide various open communication tools on our website, such as blog comments, blog posts, public chat, forums, message boards, newsgroups, product ratings and reviews, various social media services, etc. You understand that generally we do not pre-screen or monitor the content posted by users of these various communication tools, which means that if you choose to use these tools to submit any type of content to our website, then it is your personal responsibility to use these tools in a responsible and ethical manner. We have the right at our sole discretion to remove any content that, we feel in our judgment does not comply with this User Agreement, along with any content that we feel is otherwise offensive, harmful, objectionable, inaccurate, or violates any 3rd party copyrights or trademarks. We are not responsible for any delay or failure in removing such content. If you post content that we choose to remove, you hereby consent to such removal, and consent to waive any claim against us.
i. You agree to indemnify and hold harmless www.USASnax.com and its parent company and affiliates, and their directors, officers, managers, employees, donors, agents, and licensors, from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this User Agreement or the failure to fulfill any obligations relating to your account incurred by you or any other person using your account. We reserve the right to take over the exclusive defense of any claim for which we are entitled to indemnification under this User Agreement. In such event, you shall provide us with such cooperation as is reasonably requested by us.
Products will contain at least the quantity of snacks guaranteed in the product listing. A snack is defined as an individually or box wrapped piece/s of food of any weight or volume. Due to the varying nature of the products, there is no guarantee that a particular product will be included in a given box, regardless of the products displayed in the listed image or anyplace on our website and/or social media pages.
USA Snax maintains this Website as a service to the user community that visits the Website subject to these Terms and Conditions. You are responsible for obtaining any equipment and Internet service necessary to access our Website and for paying any fees for the equipment and service you select. We may alter, suspend, or discontinue this Website or the Services in whole or in part, at any time and for any reason, without notice. The Website may also periodically become unavailable due to maintenance or malfunction of computer equipment or for other reasons.
Allergies and Allergens
Some of our products may contain common food allergens; if you are unsure if a product contains an ingredient that may cause an allergic reaction, do not eat it. Although ingredients for all products we sell, are listed on the packaging, the products are manufactured externally and we therefore cannot guarantee that the ingredients are accurate or that cross-contamination did not occur. YOU ARE SOLELY RESPONSIBLE FOR DETERMINING IF THE PRODUCTS ARE SUITABLE FOR USE OR CONSUMPTION. WE ARE NOT ABLE TO PROVIDE ANY ASSURANCES REGARDING ALLERGIES.
RETURNS, REFUNDS and Cancellations
Unfortunately, due to the perishable nature of the product we are unable to accept returns. Refunds may be issued in rare instances at our discretion. You must update your account on the Website by the last day of the month after receiving the last box (before change of address) if you have any change to address, we cannot guarantee delivery of your box if the shipping address in your account is not the correct and current address.
Customers may request cancellation of their subscription Treat Box shipments up to 11:59 pm EST by the last day of the month before the month they wish to cancel future boxes. They must contact us via email communication. Any subscription renewal cancellation thereafter cannot be processed, because the customer’s box will have been processed at that time. Cancellations must be completed prior to processing and shipment, once processed or shipped we do not provide refunds or reverse charges.
YOUR SUBSCRIPTION IS CONTINUOUS UNTIL YOU CANCEL AND, IF YOU CANCEL YOUR MEMBERSHIP BEFORE THE END OF AN EXISTING SUBSCRIPTION PERIOD, YOU Must send us an email requesting cancellation by the last day of the month before the month you wish to cancel.
We may terminate your membership, without notice or refund, for conduct we believe violates these Terms and Conditions or our policies, is harmful for our business interests, or for an inactive account.
By default, USA Snax offers no refunds because the goods shipped are perishable. However, USA Snax may grant refunds on a case to case basis. If customer is approved for a refund, credit will be automatically applied to the credit card on file or original method of payment within 5-10 business days. Customer must contact firstname.lastname@example.org for refund requests.
USA Snax only has control over treat boxes while in our possession. Once they are shipped, the shipping company is responsible to make sure the box/es arrive to their destination/s in good condition. We work hard to ensure all boxes are in excellent condition before leaving our premises.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors. Prices are exclusive of all taxes, levies, or duties imposed by taxing authorities, and you are responsible for payment of all such taxes, levies or duties.
By purchasing a subscription or gift plan, you agree to pay the entire listed price for whichever subscription or gift plan you choose. For monthly subscription plans, the first month will be billed immediately upon subscribing and all subsequent months will be billed on the first of each month. USA Snax will automatically bill your credit card provided during the initial purchase for the listed amount. All subscription plans are paid for up front and can only be cancelled through logging into your USA Snax account and cancelling by the last day of the month before the month you wish to cancel. If any fee cannot be charged to your credit card for any reason, we may provide you, via email, notice of such non-payment and a link for you to update your payment information. If such non-payment is not remedied within 8 days after receiving notice of non-payment, then we may terminate the subscription without a refund.
Credit Card Processing
We use a third party payment service in lieu of directly processing your credit card information. By submitting your credit card information, you grant USA Snax the right to store and process your information with the third party payment service, which it may change from time to time; you agree that USA Snax will not be responsible for any failures of the third party to adequately protect such information. All financial matters regarding your information are subject to the conditions of the third party payment service provider’s terms of service. You acknowledge that we may change the third party payment service and move your information to other service providers that encrypt your information using secure socket layer technology (SSL) or other comparable security technology.
Price Change and Accuracy / Content Accuracy
Users have a personal, non-transferable, non-exclusive right to access and use our website for the purpose of learning more about USA Snax and for utilizing our website to manage their subscription and / or to make a purchase only. We reserve the right to make any changes to our website and information at any time without notice. We are not responsible for any information on or website, social media or on our state experience cards that is not accurate. The website information is for general informational purposes only and should not be used to help with any decision making.
Changes to pricing, services and plans
Pricing and offerings are subject to change without notice. Subscription and gift plans with recurring payments are excluded. If there are any price changes, active subscribers will be given notice within 10 days of their next payment date in advance of any changes being implemented. We reserve the right to discontinue the service or modify our methods without notice. If any of our subscription offerings are discontinued, all active subscribers will be notified and their recurring payments will end. Any subscriber /s who pre-purchased a 1, 3 or 6 month gift or subscription would receive a refund for any months remaining on their subscription.
Content on the USA Snax website and social media platforms is for informational purposes and no content or part/s of our website or social media content that we create can be modified, reproduced, copied, photocopied or used for any purposes. You may view, print and copy content on our website for non-commercial internal informational purposes only.
Registered subscribers agree to receive emails, offers and promotions from USA Snax. A monthly newsletter from USA Snax is sent out. There is a link in the newsletter to unsubscribe from the newsletter at any time.
Subscribers and Sales
Shipping and Risk of loss
Subscription boxes are usually shipped between the 4th and 15th of each month via USPS (United States Postal Service) or FedEx. Subscription boxes usually arrive between 1 – 6 days after shipping due to USPS and FedEx shipping schedules. If there is a change to their shipping schedule, you may receive notification to your subscription email with the new shipping / arrival date. Your first box will ship out asap unless you sign up 8 days before the month ends (during our grace period).
Loss and Damage
We pack each snack box carefully but once it leaves our facility it is up to USPS or FedEx to make sure your package arrives safely. We have no control over boxes once they are shipped. Usa Snax is not responsible for any snacks / snack boxes that are stolen, lost, damaged, destroyed or melted due to the shipping process.
It is your responsibility to make sure your subscription or gift subscription address is kept current in our system (through your USA Snax account accessible through our website). Any changes to your address must be made by the last day of the month prior to your next billing date (monthly subscriptions are billed the 1st of each month).
Monthly Snack Boxes
As a USA Snax subscriber, you will receive a box with snacks each month (size and number of snacks depends on your subscription) with snacks from a different state within the USA. We work hard to ensure that all snacks are made in the USA from local companies within each state. USA Snax cannot guarantee a specific snack or state will be available at any given month. By subscribing to USA Snax, you agree to pay each month for the subscription plan you chose or term of subscription if you purchase a gift subscription.
By using our service/s, website, information, snacks and purchasing snacks and / or subscribing to any of our services you completely agree and understand that any claim against us will never be more and is limited to the amount you paid, if any, to USA Snax in the prior calendar month or term for a monthly subscriptions or gift subscriptions. You understand and agree we do not guarantee, claim or represent that your use of our services will be without error, mistakes, on time, secure, be reliable, uninterrupted or correct. You understand and agree that you are using our service at your own risk. Any product or service or products you purchase from USA Snax or use from our website, social media platforms, ads or any other information you may find online or offline that we created or generated is “as is” and “when available” for your use (unless we specify differently).
Although we work hard to select snacks from different states that are all made in the USA, we do not guarantee that all ingredients used by the 3rd party manufacturers and companies creating any snacks are sourced in the USA.
You agree and understand we are not responsible for your use of our products and /or services and in no case will you ever hold USA Snax or any of our employees, directors, suppliers, managers, owners, service providers or anyone else we work with or utilize to be able to offer our products and services to you. You understand and agree to not hold any claims or damages at all against USA Snax and all others listed above for any damages or claims you may experience from using our products and services including any damages, losses, data loss, inability to utilize our website or platforms, misuse of our website/services and /or for any other reason.
You understand and agree that you are totally responsible for determining if any snack/s are appropriate for your consumption. You and / or the receiver of any gift subscription/s you order are totally responsible for determining if any snack/s are appropriate for their consumption.
WE DO NOT PROVIDE ANY INFORMATION, GUARANTEES OR ASSURANCES REGARDING ALLERGIES.
You understand and agree that you and/ or any receiver of a gift subscription from USA Snax will never hold us or any of our owners, managers, employees, directors, suppliers, etc. liable for any damages actual or implied you may incur from utilizing any of our snacks, products, services or content online and offline.
You understand and agree that by using our products and / or services you hold USA Snacks free of any claims, damages and /or warranties.

There may be links on our website, services / social media platforms or any other information and/ or content USA Snacks generates to put online. Some of the content / information may involve the display of third-party links. Third-party links may lead or direct you to third party websites, social media platforms or other content. USA Snax has no control over any content or materials displayed via third-party links. We do not check or review any third-party link content or websites. You understand and agree to not hold USA Snax liable for anything related to any third-party links, websites, social media platforms or anything else related to any third-party links, content or materials.
